CONTENT OF THE SERVICES

1. General Provisions

These General Terms and Conditions of Sale supersede any general terms and conditions of purchase, which are not enforceable against Filver. Any reservation or purchase of a service from Filver implies the customer's acceptance of these General Terms and Conditions of Sale.

Filver declines all responsibility for the consequences of clients' failure to comply with these General Terms and Conditions of Sale and with all applicable general and specific regulations. This is without prejudice to any damages that Filver may claim as a result of this non-compliance.

2. Cruise Regulations

2.1 Service Commitment

Filver will do everything within its power to ensure the smooth operation of the cruise as stipulated in the booking conditions.

2.2 Passenger Obligations

  • From the moment of boarding invitation, each passenger must immediately and strictly follow the instructions given by the crew.
  • The introduction of any equipment that could be deemed dangerous for passengers or the crew, as well as any animals (unless explicitly agreed upon), is not permitted on the vessel.
  • Filver reserves the right to refuse boarding or to disembark any passenger in the event of non-compliance with the instructions of the on-board personnel. The crew may also decide to interrupt navigation if passenger safety regulations are violated.
  • Parents are required to supervise their children throughout the cruise, including during the embarkation and disembarkation phases.
  • Filver declines all responsibility for theft, loss, or damage to clothing, hand luggage, or passenger equipment.

3. Conditions of Reservation / Payment

3.1 Firm Reservations

Reservations become definitive only after the payment of the total amount for the service reserved has been made and agreed upon with the client.

3.2 Schedules

The schedules are agreed upon with the client and accepted by them. Filver reserves the right to shorten the cruise duration by a period equivalent to the delay in embarkation caused by the client, if the client wishes and if Filver is able to accommodate. Additionally, Filver may bill for the excess time incurred due to this delay on a pro rata basis.

3.3 Invoicing / Payment

The service must be paid in full to Filver before departure. Any additional charges (such as overtime or additional services requested by the client) may be settled at the end of the service. Payment can be made via credit card or bank transfer. Upon payment, an email will be sent to confirm your booking and provide the captain’s contact details, which you may use if necessary.

4. Cancellations

4.1 Company Cancellations

Filver reserves the right to assess whether or not the conditions are suitable for the service (e.g., river navigability for cruises) and therefore may cancel or modify the services at any time from the time of booking, including on the day of departure.

Services may also be canceled in the event of adverse weather conditions that could jeopardize the safety of the persons transported, or due to any material impossibility of carrying out the service, including but not limited to damage to the vessel, mechanical failures, strikes, or non-payment by the client. In the event of cancellation by Filver, any advance payments received will be returned to the client, without further compensation.

4.2 Cancellations by the Customer

  • If cancelled more than 72 hours before the service, 90% of the total amount will be refunded.
  • If cancelled less than 72 hours but more than 48 hours before the service, 50% of the total amount will be refunded.
  • If cancelled less than 48 hours before the service, no refund will be possible.

In the event of a passenger delay of more than 30 minutes, Filver reserves the right to cancel the service without reimbursement of the amount paid, without other compensation.

5. Minors

5.1 Reservations by Minors

Reservations made directly by minors will not be accepted. Reservations for underage passengers must be made by persons exercising parental authority or other legal guardians and will only be accepted if the minor is accompanied on the journey by at least one of their parents or a designated adult who assumes all responsibilities for the minor during the journey.

5.2 Alcohol Policy

In compliance with French law, the sale or gratuitous offering of alcohol to individuals under the age of 18 is strictly prohibited.

6. People with Reduced Mobility

6.1 Accessibility

Not all areas and facilities of Filver's vessel are accessible to persons with disabilities or reduced mobility, nor are they specifically equipped to accommodate such individuals. Therefore, reservations from persons with disabilities or reduced mobility will be accepted on a case-by-case basis, subject to availability and, where necessary, contingent upon the presence of an attendant capable of assisting them throughout the service. This policy is in accordance with the provisions of Regulation (EU) No 1177/2010 concerning the rights of passengers when traveling by sea and inland waterways.

7. Applicable Laws

In the event of a dispute or contestation, the French courts shall have exclusive jurisdiction and French law shall apply. Disputes involving commercial entities will be submitted to the Tribunal de Commerce de Paris.
